Terms and Conditions – Adventure Beyond Chania

These Terms and Conditions govern the booking and participation in activities and tours offered by Adventure Beyond Chania. By booking with us, you acknowledge and agree to the following:

1. General Information

Adventure Beyond Chania facilitates the booking of tours and activities.

2. Booking and Payment

• A booking is confirmed upon receipt of a completed booking form and the required deposit or full payment. By booking via telephone, website, or email, you are deemed to have agreed to these Terms and Conditions.
• The balance of payment for group tours is due no later than one day before departure. For private and corporate events, the balance is due 15 days before departure. Failure to pay by the due date may result in cancellation of the booking.
• Payments made for tours operated by Adventure Beyond Chania are held for the client until confirmation of the booking.

3. Cancellation Policy

• Group Participation Tours:
  
  • Cancellations must be made at least 24 hours before the scheduled departure.
  • Cancellations made less than 24 hours before departure will be charged 100% of the tour price.
  • Cancellations made 24 hours or more before departure: Retention of the deposit.
  • Adventure Beyond Chania reserves the right to cancel a tour due to insufficient participants or adverse weather conditions, in which case a full refund will be issued.
• Private Tours:
  
  • Cancellations must be made at least 7 days before the scheduled departure.
  • Cancellations made:
    
    • 7 days or more before departure: Retention of the deposit.
    • 6 to 3 days before departure: 50% of the total tour price.
    • Less than 2 days before departure: 100% of the total tour price.
  • Adventure Beyond Chania reserves the right to cancel a tour due to insufficient participants or adverse weather conditions, in which case a full refund will be issued.

4. Insurance

• Clients are responsible for obtaining adequate personal travel insurance, which is mandatory for all tours organized by Adventure Beyond Chania.
• Insurance should cover, at a minimum, medical expenses, injury, death, repatriation, cancellation, and curtailment.
• Clients are responsible for ensuring that their insurance policy covers the activities included in their tour.
• Adventure Beyond Chania holds limited liability insurance. Clients should assume they are not covered by Adventure Beyond Chania’s insurance policy for death, injury, damage, or any other loss.

5. Tour and Activity Participation

• Clients agree to abide by the authority and decisions of Adventure Beyond Chania’s employees, tour leaders, and agents.
• Adventure Beyond Chania may exclude a client from a tour if their health, fitness, or conduct is deemed to endanger the safety, comfort, or enjoyment of others. No refund will be provided in such cases.
• Clients must notify Adventure Beyond Chania at the time of booking of any medical conditions that may affect their participation in a tour.
• No refund will be given for any unused services.

6. Tour or Activity Changes/Cancellations by Adventure Beyond Chania

• While Adventure Beyond Chania will make reasonable efforts to operate tours as advertised, changes to the itinerary may be necessary.
• Adventure Beyond Chania reserves the right to change any facilities or services before a booking is made.
• If a major change is made, clients will be informed and given the option to accept the change, purchase an alternative tour, or cancel for a full refund.
• Adventure Beyond Chania reserves the right to cancel a tour, but will not do so less than 15 days before departure, except in cases of force majeure, consolidation, or client’s failure to pay the final balance.
• In the event of cancellation by Adventure Beyond Chania (excluding client’s failure to pay), clients will be offered a full refund or an alternative tour.
• Force majeure includes events beyond Adventure Beyond Chania’s control, such as war, civil unrest, natural disasters, etc.
• Adventure Beyond Chania is not liable for any costs associated with connecting airfares in the event of a tour change, date change, or cancellation.

7. Responsibility for Tours and Activities

• Clients acknowledge the inherent risks of adventure activities and participate at their own discretion.
• Clients are responsible for being aware of potential risks through resources such as government travel advisories.
• Adventure Beyond Chania is not liable for any delays, deviations, or omissions from a tour due to circumstances beyond its control.
• Adventure Beyond Chania is not liable for any expenses incurred by clients due to their booking.
• Adventure Beyond Chania acts as an activity booking company and is not liable for the actions or omissions of independent parties, accidents, loss, damage, delays, etc.
• Adventure Beyond Chania is not liable for any action or activity undertaken by the client independently of Adventure Beyond Chania while on tour.
• Adventure Beyond Chania’s liability is limited to circumstances arising from a failure to exercise due diligence in the selection of its agents, negligence of its employees causing death or personal injury, or to the extent of recovery by the client under their insurance cover.

8. Quad Safari Specific Terms

• 8.1 Acknowledgment of Risk:
  
  • Clients acknowledge that quad motor riding is an inherently risky activity, especially off-road, and accept the possibility of injury, loss, or damage to personal belongings.
• 8.2 Release of Liability:
  
  • Clients release Adventure Beyond Chania, its directors, employees, sponsors, volunteers, assistants, representatives, and agents from any liability related to quad motor activities.
• 8.3 Agreement and Confirmation:
  
  • Clients confirm that:
    
    • They are in good health and physically fit to ride a quad motor.
    • They are free from the influence of alcohol or drugs.
    • They have notified Adventure Beyond Chania of any relevant medical conditions.
• 8.4 Compliance with Instructions:
  
  • Clients will comply with all instructions from Adventure Beyond Chania representatives and tour guides.
  • Clients acknowledge they are exposed to increased risks.
  • Clients will not engage in dangerous or illegal riding.
  • Clients will follow the designated trail.
  • Clients may be excluded from the tour for safety reasons without reimbursement.
  • Clients will respect the environment and equipment.
  • Clients accept liability for damage or injury caused by their actions.
• 8.5 Liability for Damage:
  
  • Quad motor insurance is limited to third-party liability.
• 8.6 Release of Claims:
  
  • Clients release Adventure Beyond Chania from claims related to injury, loss, or damage.
• 8.7 Modifications:
  
  • Changes to these terms must be in writing and signed by both parties.
• 8.8 Participants Under 18:
  
  • Parent/guardian consent is required.

9. Intellectual Property

• All content on the Adventure Beyond Chania website is protected by copyright.
• Unauthorized use of the content is prohibited.

• Adventure Beyond Chania is not responsible for the content or privacy practices of linked websites.

12. Governing Law and Jurisdiction

• These Terms and Conditions shall be governed by Greek law.
• Any disputes arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of  Chania, Crete, Greece.
